Since you have given your subscribers an option to subscribe to your list, you should also provide them an unsubscribe option, preferably at the end of each mail. Make sure that when someone opts to unsubscribe from your email marketing list, then you should respect that person and immediately remove him/her from your list.

Once that a person chose to unsubscribe to your list and if they have been receiving your email marketing promotions, then it is already considered as a spam.
